Definitions

 

Claus Mobi GmbH is the provider of the dating website XS2Date.

‘The Service Provider’, ‘we’, ‘us’ and ‘our’ refers to the Service Provider and/or its employees, affiliates or parent.

‘’XS2’, ‘Website’ or ‘Service’ refers to the XS2 dating network and websites (including but not limited to the XS2SX, XS2Date, XS2Flirt, XS2Friends and XS2Fun websites) and all of its functionalities.

‘User’, ‘you’ and ‘your’ refers to the user of the Service.

 

Preamble

 

We have created this Privacy Policy to demonstrate our commitment to communicating our privacy practices to our visitors. We realize the importance of feeling safe online and want the user (‘you’) to feel comfortable while using the Website.  

 

This Privacy Policy has become effective on 1 August 2015. The Service Provider reserves the right to modify or amend this Privacy Policy at any time and for any reason. If there are material changes to this statement or in how the Service Provider will process your personal data, the Service Provider will prominently post such changes in a way that enables you to take notice from such change prior to implementing the change.

Regardless of later updates, the Service Provider will abide by the information privacy practices described in this Privacy Policy at the time you provided the Service Provider with your information.

 

 

Information collected

 

Registration data. In order to provide you with personalized services and features, we ask you to register with us and establish your personal profile. During the subscription process we can request, but not exclusively, your (user) name, gender, age, email address and password for authentication.

 

When you establish your XS2 profile, you can add further information about yourself, such as your date of birth, place of residence, physical characteristics, ethnicity, languages, occupation, education, religion, etc. When you wish to search for other users that you might be interested in, you can select certain criteria including but not limited to gender, age, physical characteristics, location, etc.

 

You can also add pictures to your profile. User pictures from the device library will not be collected without your permission. Adding a picture to your profile is required in case you wish to send messages or ‘teases’ to other users.

 

Message-related information. If you are subscribed to the Service and have uploaded a profile picture, you can make use of the message function of the Website. If you make use of this feature, we collect, process and store, among other things, information related to the contents of the messages, the author and user name, time stamps, and other relevant information for administration purposes. Information that you display via the message function can be read by the other user(s) to whom you send your message.

 

Information related to customer service and support. If you contact customer support we will collect and store the information you provide to us including any records of your correspondence. In case you provide feedback to us, or participate in any customer survey, we will store the information that you provide us with.

 

Cookies. When you visit the Website, we send cookies to your computer or your mobile device. Cookies are small files with a series of alphanumeric characters. We use cookies to identify your mobile device or computer, which allows you to log in faster and more quickly navigate through the Website. Cookies can also transmit information about how you use the Website.

We use permanent cookies and session cookies. Permanent cookies remain on your hard disk or mobile device after you close your browser, and these cookies are used the next time you visit the Website. These cookies can be removed by changing your privacy settings on your browser.

Session cookies are temporary and disappear when you close your browser.

You can set your browser to refuse all cookies or to inform you when cookies are sent. Take note that some functions of the Website may possibly not function properly if you disable cookies.


Identifiers. We may access so-called “identifiers” and collect, monitor and store them. If you have access to the Website via a mobile device, this involves device identifiers. If you have access to the Website via your computer, it involves your browser.

“Device identifiers” are small data files or similar data structures that are stored or linked to your mobile device and that can identify your mobile device uniquely and be used by us to improve your use of the Website. Device identifiers can be stored in connection with hardware and/or software data of your mobile device or in connection with other information that we send to your device.

Identifiers may contain information about how you use the Website. Device identifiers do not collect any personal data about you, but can be used in combination with other information linked to your personal data. An identifier may be stored on your mobile device or computer so that you can log in faster to the Website and make better use of our Service. If you block or limit the use of the device identifiers, some functions or parts of the Website may not function properly.

 

Log file information. Log file information is reported automatically by your browser or mobile device every time you access a web page. If you use the Website, our server automatically stores the log file information. This information may consist of, but is not limited to: Internet Protocol (“IP”) address, type of browser, log in time and date, referring / exit pages and URLs, the number of clicks, information about links, domain names, landing pages, pages viewed, and other similar information.

 

Web beacons. When you use the Website, we can use so-called “web beacons”. Web beacons are pieces of data, which are embedded invisibly on web pages that are used to follow the online usage patterns of users from one web page to the next in order to improve the use of the Website.

In addition, we can also use web beacons in HTML-based email messages that are sent to our users to find out which email messages are opened. This information is used to optimise the effectiveness of our marketing efforts and improve the Website for our users.

 

Third Party Networks. We use a third party advertising company to serve ads on our behalf across the Internet. That advertising company may also collect anonymous information about your use of the Website.  These companies may employ cookies and action tags (also known as single pixel gifs or web beacons) to measure advertising effectiveness.

 

Data from third parties. We can collect personal data about you that we have obtained legally from third parties. For the purposes described in this Privacy Policy, we can combine the personal data about you that we have received.

Purpose of collecting personal data and use of personal data

 

We use the above-mentioned personal data to perform the Service that you use on or by means of the Website, for statistical analysis and for improving our services.

 

Please note that for the purpose of your use of the Website, the personal data that you have provided in your user profile may be shown to other users of the Service, e.g. to encourage interaction on the Website. By signing up for the Service and establishing a profile for XS2, you acknowledge and agree that your XS2 profile may be displayed on all websites belonging to the XS2 Network (including but not limited to the XS2SX, XS2Date, XS2Flirt, XS2Friends and XS2Fun websites) and other dating websites owned or operated by us (‘Other Claus Mobi GmbH Websites’). Users of the XS2 Network and Other Claus Mobi GmbH Websites can view your profile and contact you. The profiles from users of the XS2 Network and Other Claus Mobi GmbH Websites can also be displayed in the Website and you can interact with those users  in case you have subscribed to XS2.

 

Certain profiles displayed in the Website may be from users who did not sign up for XS2, but for similar dating websites owned or operated by our Partner (‘Partner Websites’). You can see the profiles from these users of Partner Websites and interact with the users from the Partner Websites in case you have subscribed to XS2. Your profile will not be displayed on the Partner Websites so these users from Partner Websites cannot initiate contact with you. Only in case you initiate contact with a user from one of the Partner Websites will your profile be shown to this user.

 

We also use your personal data to inform you about our services and promotions.

 

Providing personal data to third parties

 

We do not sell, pass or disclose your personal data to third parties, except in the below circumstances:

 

We may employ third parties, so-called processors of personal data, to perform our services and for the purpose of processing personal data. These processors work on our instructions and will only process your personal data on behalf of and for use by us.

 

In addition, if we want to effect a merger, takeover, sale or other transaction whereby our database may be acquired by a third party, we may disclose your personal data to our advisors and to the third party, both before and after the transaction, exclusively for the purpose of facilitating and effecting that transaction. If such a transaction is completed, you will be informed about the transaction and we will transfer the ownership and the management of your personal data to the third party, subject to all provisions and limitations of this Privacy Policy. If the transaction is not completed, we will prohibit the third party from further using your personal data or disclosing it in any way and   we will also require that third party to securely delete the personal data

We can also transfer your personal data to a third party to which we transfer our rights and obligations on the basis of our agreement with you.

 

We can provide your personal data to third parties if we believe in good faith that this is necessary (a) in order to comply with the law or court rulings; or (b) in order to protect or defend the rights of the Service Provider or a third party’s rights or (c) in order to protect someone’s life, health or safety, such as when harm or violence against any person (including you) is threatened.

 

Notwithstanding any other provision of this Privacy Policy or the XS2 Terms and Conditions, we reserves the right, but have no obligation, to disclose any information that you provide to us, if in our sole opinion, we suspect or have reason to suspect, that the information involves a party who may be the victim of abuse in any form. Abuse may include, without limitation, elder abuse, child abuse, spousal abuse, neglect, or domestic violence. Information may be disclosed to authorities that we, in our sole discretion, deem appropriate to handle such disclosure. Appropriate authorities may include, without limitation, law enforcement agencies, child protection agencies, or court officials. You hereby acknowledge and agree that we are permitted to make such disclosure.

 

Special personal data

 

Certain personal data that you provide to us can be designated as ‘special personal data’. Examples of this kind of personal data include information about your racial or ethnic background, political beliefs, religion, state of health or sexual preference. By agreeing to this Privacy Policy, you give us explicit permission to process such data in accordance with this Privacy Policy if you have provided it to us. However, we do not pass special personal data on to third parties for direct marketing purposes.

 

Protection of minors

Protecting the privacy of minors is important to us. For that reason, we do not knowingly collect or maintain personally identifiable information or non-personally-identifiable information from persons under 18 years of age, and no part of our services is directed to persons under 18. If we learn that personally identifiable information of persons under 18 years of age has been collected through the services without verified parental consent, then we will take the appropriate steps to delete this information.

 

Age restrictions

 

Our age restrictions are set forth in the XS2 Terms and Conditions. We do not target the Service to persons under the age of 18. If we learn that a person under the age of 18 has provided personal data to us, we will delete the information as soon as possible.

 

Transfer of personal data outside of the EEA or your own country

 

Currently the XS2 data file is stored centrally in Germany. You agree that we can transfer your personal data to third parties in other countries for the purpose of centralising the files or for processing as described in this Privacy Policy. Some of those countries might not be part of the European Economic Area (‘EEA’) or are outside your own country. Countries outside of the EEA or countries other than your own country might not have the same laws for data protection as the EEA or your own country. If we transfer your information to countries outside the EEA or your own country, we will take measures to ensure that your privacy rights remain protected in the same way as inside the EEA or your own country. In addition, your data, if you use our services while you are outside the EEA, can be transferred outside the EEA in order to supply you with these services. By agreeing to this Privacy Policy, you also provide permission for the transfer of your personal data outside the EEA or your own country for the purposes described. At your request we will provide you with a list of the countries to which your personal data is transferred.

 

Online communications in public forums


Please be aware that personally identifiable information voluntarily included and transmitted online by you in a posting, comment, profile or other public forum may be viewed and used by others. We are not able to control such uses of your personally identifiable information, and by using such services you assume the risk that the personally identifiable information provided by you may be viewed and used by third parties. You also assume the risk that you might be exposed to objectionable content and conduct by using public forums.

 

External links

 

The Website may contain banners and links to internet sites and advertisements (‘external links’). You acknowledge that we are not responsible for, and have no liability as a result of, the availability of external links or their content. We cannot be held responsible for the privacy practices or the content of these advertisements or websites. 

 

Security

 

We treat all your data confidentially and will take all reasonable measures to protect your personal data. However, we cannot guarantee the security of the data that you provide online. You accept the inherent security risks of providing information and transactions via the internet and you cannot hold the Service Provider liable for a breach of the security, unless this is the result of negligence or intentional failure of the Service Provider.

 

Cancellation of subscription

 

When you cancel your subscription, your profile will remain visible to other users. Your profile and other personal data we may have collected is stored in the XS2 database and will remain in this database for a period of 2 years after you have cancelled your subscription or after you have used the Website for the last time, whichever is the latest, unless we, for reasons of any statutory provision, are obliged to store (parts of) your personal data for a longer period.

After cancellation of your subscription, your profile will not be accessible to you anymore. When you reactivate your subscription, you can access your profile again and will regain all functionalities of the Website.

 

Deletion of profile and other personal data

 

In case you wish to delete your profile to ensure that your profile cannot be viewed by other users or yourself anymore, please contact our Customer Care service by sending an email to: info.uk@xs2date.com.

 

Please note that after deletion the profile and other personal data we may have collected remains stored in our database for a period of 2 year after deletion of your profile unless we, for reasons of any statutory provision, are obliged to store (parts of) your personal data for a longer period. If you want to have the profile and other personal data we may have collected removed from our database before the end of this period of 2 years, please contact our Customer Care service by sending an email to info.uk@xs2date.com.

 

Also, please note that any messages you send to other users through the Website may be retained by such users and therefore will not be entirely removed from our service.

 

In general, your personal data is stored by the Service Provider for no more than two years after your last use of the Website, unless we, for reasons of any statutory provision, are obliged to store (parts of) your personal data for a longer period. If you want us to delete all your personal data, you can send an email free of charge to info.uk@xs2date.com and state this.


Access to data

 

On request and upon verification of your identity, you can inspect the personal data that we have collected about you, and if necessary, correct it. In order to make use of this right, you can send an email to info.uk@xs2date.com.
